» Data Protection Agreement
1.1. The information provided by the Client may be processed for the purposes of carrying out the obligations of this agreement and the law.
1.2. Information may be processed using computer media and paper archives appropriate for ensuring maximum security and confidentiality in compliance with the above-mentioned legislation and associated obligations in accordance with the purposes and procedures illustrated in this information report.
1.3. The transfer of information, for the purposes mentioned in point 1.1., is mandatory and any refusal to provide such information shall result in the inability to comply with the obligations imposed by the law and the obligations deriving from the contract, with the further consequence that such contract may not be completed. Therefore any request for cancellation of the information required for the execution of obligations deriving from the contract and at law, or the refusal to transfer said information, shall result in the partial or total inability to continue with the contractual relationship, including during the course of performance of the contract.
1.4. The information may be communicated to banks, credit companies, delivery companies, postal companies and, in general any companies or individuals used by Joelle Marie Events for the performance of the contractual obligations or for the fulfilment of obligations provided at law. The Client’s personal data will not be disseminated.
1.5. The Controller of information processing is Joelle Marie Events, referred to above.
1.6. The Manager in charge is Joelle Marie Claire Edwards.
1.7. The Client’s personal information may be processed not only by the Controller and Manager but also by the processors or employees of Joelle Marie Events, by its collaborators and/or consultants, again for the purposes specified at paragraph 1.1 above and subject to the appointment of the Processors, by the Controller/Manager, including specific instructions required for compliance with legislation regarding the protection of personal information with particular reference to security-related aspects.
1.8. The Client may exercise his/her rights, at any time, against the Controller of Information Processing pursuant to Art. 7 of Legislative Decree no. 196/2003, and ask Joelle Marie Claire Edwards for information as to: a) the origin of the personal information; b) the purposes and procedures of the information processing; c) the logic applied with regard to information processing operations performed by electronic means; d) the identification data of the controller and managers; e) the subjects or category of subjects to whom the personal information may be communicated or by whom it may become known in the subject's capacity as a representative appointed in the State's territory, managers or processors.
1.9. The interested party is entitled to obtain:
a) the updating, correction or, where appropriate, the integration of the information;
b) the cancellation, transformation into an anonymous form or barring of information processed in violation of the law, including with regard to the storage of information which is unnecessary for the purposes for which the information was originally collected or subsequently processed;
c) a declaration that the operations mentioned in letters a) and b) were brought to the knowledge of those to whom the information was communicated or disseminated, including with regard to the contents of such information, with the exception of situations in which compliance proves impossible or entails the use of funds manifestly disproportionate to the protected right.
1.10. The interested party is entitled to object, in whole or in part:
a) to the processing of personal information concerning him/her, even if pertinent to the purpose for collection if the grounds for doing so are legitimate;
b) to the processing of personal information concerning him/her for the purpose of sending advertising material or making direct sales or conducting market research or market communication research.
1.11. By signing this Agreement, the Client hereby acknowledges that the information supplied by the company regarding the handling of data as set out in article 13 of law no 196/2003, is taken into account in the preceding information and authorises the handling of his/her data as set out above, including sensitive data, for the purposes of and in accordance with the procedures indicated in this information summary.
